President Donald Trump and President Joe Biden were both investigated for the same thing during the Biden years, but where Trump saw his home raided, documents seized, and federal charges brought, Biden was classified as a dotty old man who could never stand trial and was never held accountable for his actions. Hur opted against prosecuting the President, just as special counsel Jack Smith fought hard to prosecute Trump.
Though the audio of the interviews with special counsel Robert Hur, who investigated the classified documents claims against Biden, was requested by Congress, they were never delivered. Now, the Trump administration, per Politico, may be "making plans to release the audio."
"The Hur audio will confirm what is one of the biggest cover ups in American history," said Trump ally Mike Davis. During the Hur investigation, Biden said he didn't break any laws regarding the handling of classified documents and further proclaimed that his "memory is fine," despite Hur's findings to the contrary.
Congress was able to obtain redacted, written transcripts, but given Hur's findings, namely that Biden was not able to stand trial, there was reason to believe that Biden's mental faculties were already in decline at the time the interview was conducted.
Biden absconded with classified documents during his time both in the Senate and as vice president under Barack Obama. Some of these documents were kept in his scattered offices while others were kept in boxes in his garage next to his Corvette.
When special counsel Robert Hur was brought in to investigate Biden's handling of classified documents, he determined in the end that a jury would find him to be a "well-meaning elderly man with a poor memory."
Congress demanded release of the records, but Biden asserted executive privilege and refused to allow the unredacted interview transcripts to be released. It was also revealed in Hur's testimony before the House Judiciary Committee that the White House attempted to get Hur to alter the transcript.
Biden's Attorney General Merrick Garland refused to hand over the transcript in full because, he asserted, witnesses would be less likely to be forthcoming with the DOJ in the future if they knew transcripts of testimony could be released. He refused to comply with a congressional subpoena for the material and instead gave this excuse. He was not imprisoned.
Now, as the May 30 deadline to deliver on Freedom of Information Act requests from both Judicial Watch and the Heritage Foundation looms, officials with Trump's DOJ will have to decide whether to honor Biden's invocation of executive privilege or not.
It must be noted that during the Biden years, Trump's previous invocations of executive privilege were not honored and, as a result, both Steve Bannon and Peter Navarro were imprisoned for contempt of Congress after failing to divulge that which was under executive privilege.
